There is no such thing as "legal separation" in Texas. You are either married or divorced. When it's time to get divorced, then you start right in with the divorce proceedings. In order to get a divorce in Texas:

  • At least one spouse must be a resident of Texas for six (6) months or more.
  • The person seeking divorce or his or her spouse must be a resident of the county in which he or she is seeking divorce for ninety (90) days or more.
