What Is Estate Planning?

Estate planning is generally concerned with two issues: 1) protecting your property from unnecessary expenses and taxes, and 2) determining exactly to whom you wish to give your property.

  • Wills: a written legal instrument that conveys your wishes upon death
  • Trusts: instructions that can take effect either before or after you die, which control how certain property is used or distributed
  • Powers of attorney: a grant of permission stating that another person can act on your behalf in either every matter or specifically defined matters
  • Living will/advanced healthcare directive: a document that defines what you want to happen if you should become incapacitated; usually a living will has less authority than a power of attorney
